IEBC Instant Digitizer Terms

Automated software — review and sew-out required

IEBC Instant Digitizer is automated software, not a human digitizing service. It can misread artwork, choose an unsuitable stitch type, density, sequence, underlay, compensation, trim/jump route, color order, size, or other production setting. Generated DST, PDF, previews, warnings and recommendations may contain errors.

No quality, sewability or production-result guarantee is made. You are responsible for reviewing every output in appropriate embroidery software and completing a physical sew-out on representative material before production. Do not rely on the preview or a “ready” status as a substitute for production testing.

Your production responsibility

You decide whether a generated file is suitable for a machine, hoop, needle, thread, garment, cap frame, material or order. You are responsible for machine setup, operator safety, maintenance, thread/needle selection, garment replacement, customer approval and final production. Stop use if a file produces unsafe, damaging or unexpected machine behavior.

Acceptable use — no adult/NSFW content

Do not use Instant Digitizer to upload, process, create, store or facilitate pornography, sexually explicit content, sexualized nudity, adult sexual services or other NSFW/adult material. Unlawful, exploitative, infringing, malicious or abusive content and attempts to bypass security, trial, billing or usage controls are also prohibited.

Artwork and intellectual property

You must have all rights and permissions needed to upload, process, store, reproduce and embroider the artwork. You are responsible for trademarks, copyrights, publicity rights and customer authorization. Do not upload unlawful, infringing, malicious or unauthorized content.

Files, storage and email delivery

Generated files may be stored in your account and, for IEBC subscribers, in the business cloud file allowance. You are responsible for keeping independent copies of production-critical files. Email delivery is provided as a convenience and is not guaranteed to be instantaneous or permanent.

Service availability and limits

Generation limits, file limits, processing capacity and subscription entitlements may be enforced server-side. IVIXICO may temporarily throttle or suspend processing needed to protect the service, users or infrastructure. Attempts to bypass quotas, access controls or security measures are prohibited.

Billing, free trial and subscriptions

The standalone 3-day free trial requires a valid payment method through the merchant-of-record checkout. No subscription fee is collected during the stated trial period. Unless you cancel before the trial ends, the selected paid subscription begins automatically and the payment method is charged the price shown at checkout. Standalone subscriptions then renew according to the checkout terms until cancelled. Trial eligibility may be limited to one trial per customer, account, payment method, business or other reasonable anti-abuse identifier. Promotional prices apply only as stated at checkout. Taxes may be added by the merchant-of-record/payment provider. IEBC Business Cloud plan access to Instant Digitizer follows the Business Cloud plan allowance. White Label includes up to 150 digitizations per month. An eligible paid standalone Instant Digitizer Premium subscription includes unlimited digitizing and effective White Label Business Cloud access while that paid Premium entitlement remains active. The 3-day standalone trial does not include the White Label Business Cloud bundle; bundled White Label access begins after the first successful paid charge.

Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, the service and generated output are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, embroidery quality or production readiness. IVIXICO and its affiliates are not liable for indirect, incidental, special, consequential, exemplary or production-loss damages, including damaged garments, lost thread/material, machine downtime, missed deadlines, lost profits or customer claims arising from use of automated output.

To the maximum extent permitted by applicable law, aggregate liability relating to Instant Digitizer will not exceed the amount actually paid for the affected service during the three months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot legally be excluded or limited.

General terms

The applicable IVIXICO / IEBC Terms of Service, Privacy Policy and Refund Policy continue to apply. If these product-specific terms conflict on automated digitizing risk, these product-specific terms control for Instant Digitizer.
